Simmers also pled guilty to one count of Residential Contractor Fraud and received seven years with the Department of Corrections. Those sentences are to run consecutive to each other for a total of twelve years. Of the twelve years, three years must be served in the Custody of DOC. The remaining nine years were suspended, and the defendant was placed on probation for three years. For count two, the defendant was ordered to pay $43,000 and execute a civil monetary judgment for that amount. Both cases occurred to victims that hired Simmers for home repairs during the 2016 flood. Both victims provided Simmers with the amount of money listed upfront, and Simmers never performed any work on either home.
